Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you (the "User", "you") and Known Click Technologies Private Limited ("KCT", "we", "us", "our"), a company incorporated under the laws of India (CIN: U62090GJ2025PTC164167), with its registered office at SF-203, Sayam Sapphire, Opposite Madhuban Resort, Karamsad, Anand, Gujarat 388325. KCT operates the brand MiniVelvet and the website minivelvet.com (the "Site").

By accessing the Site, creating an account, or placing an order, you confirm that you have read, understood, and accept these Terms together with our Privacy Policy, Cookie Policy, Shipping Policy, and Refund Policy. If you do not agree, please do not use the Site.

1. Eligibility

The Site is intended for users who are at least 18 years old and legally able to enter into contracts under Indian law. We currently sell and ship only within India. By placing an order, you confirm that you meet these requirements.

2. Your account

You are responsible for keeping your account, mobile number, and OTPs secure. Activity on your account is treated as authorised by you. Notify us immediately at [email protected] if you suspect unauthorised use. We may suspend or terminate accounts in case of fraud, abuse, chargeback, or breach of these Terms.

3. Ordering and acceptance

All orders placed on the Site are an offer to purchase, subject to availability and our acceptance. We may refuse, limit, or cancel any order at our sole discretion before dispatch — for example in case of incorrect pricing, suspected fraud, restricted pincodes, bulk-buy patterns, or stock unavailability — and will refund any amount already paid for such cancelled orders.

4. Pricing and taxes

All prices are listed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. Prices may change without notice; the price displayed at the time of order confirmation is the price that applies to that order.

5. Payment

We accept payments through Razorpay Software Pvt Ltd, our payment gateway, which supports UPI, debit and credit cards, net banking, and wallets. Cash on delivery is offered for eligible pincodes, subject to a handling fee. Payments are processed by Razorpay under its own terms; we do not store full payment-instrument details. Failed, duplicate, or unauthorised transactions are governed by RBI rules and Razorpay's resolution process.

6. Shipping, returns, and refunds

Delivery timelines, charges, and serviceable areas are described in our Shipping Policy. Returns, cancellations, and refunds are governed by our Refund Policy. Both are incorporated into these Terms by reference.

7. Loyalty points

  • Points have no cash value and cannot be transferred or sold.
  • Welcome bonus is issued once per verified phone number.
  • Points apply at checkout subject to MiniVelvet's current redemption policy. Some orders may be fully covered by points; others may have a per-order cap.
  • Earned points expire 1 year from award; promotional points expire as stated.
  • On refund of an order paid partly with promotional points, those points are forfeited.
  • Points may be revoked or balances adjusted in cases of fraud or abuse.

8. Communications and marketing

By creating an account or placing an order, you consent to receive transactional communications (order confirmations, OTPs, shipping and delivery updates, refund alerts) by SMS, email, and WhatsApp — these are necessary to fulfil your order and you cannot opt out without losing the related service. Marketing messages on Email, SMS, WhatsApp, and Instagram are sent only with your opt-in and you can withdraw consent at any time, as described in our Privacy Policy.

9. Intellectual property

All content on the Site — including but not limited to the MiniVelvet name, logos, trademarks, product images, photography, copy, design, code, and arrangement — is owned by or licensed to KCT and is protected under Indian and international intellectual property law. The MiniVelvet brand and associated marks are used by KCT under exclusive licence. You may not copy, reproduce, distribute, scrape, modify, frame, mirror, or create derivative works from any part of the Site without our prior written consent. Limited personal, non-commercial use — such as sharing a product link with a friend — is permitted.

10. User-generated content

If you submit reviews, photographs, comments, or other content to us — directly through the Site or by tagging us on Instagram, Facebook, WhatsApp, or other platforms — you grant KCT a worldwide, royalty-free, perpetual, irrevocable, sub-licensable licence to use, reproduce, modify, adapt, publish, and display that content in connection with the MiniVelvet brand, including in marketing and advertising on any channel. You confirm that the content is yours, does not infringe any third-party rights, and is not unlawful, abusive, or misleading. We may remove any content at our sole discretion.

11. Prohibited uses

You agree not to:

  • Use the Site for any unlawful, fraudulent, or harmful purpose;
  • Resell our products without our written authorisation, or list them on any unauthorised marketplace;
  • Use bots, scrapers, or automated tools to access the Site, place orders, or game pricing/promotions;
  • Reverse-engineer, decompile, or attempt to extract source code from the Site;
  • Interfere with the Site's security, availability, or integrity;
  • Impersonate another person, or use abusive, threatening, or hateful language in any communication with us or our staff.

12. Product information and disclaimer

We make reasonable efforts to ensure product descriptions, ingredients, and images are accurate, but minor variations in colour, packaging, or texture may occur. Our products are cosmetics intended for external use only. Information on the Site is for general awareness and is not medical advice. If you have a skin condition, allergy, or are pregnant or nursing, consult a qualified healthcare professional before use. Discontinue use and seek medical attention if irritation occurs.

13. Limitation of liability

To the maximum extent permitted by law, KCT, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profit, revenue, data, or goodwill, arising out of or in connection with your use of the Site or our products. Our total aggregate liability for any claim arising under or in connection with these Terms shall not exceed the total amount actually paid by you to KCT for the order giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Indemnity

You agree to indemnify and hold harmless KCT, its directors, officers, employees, agents, and affiliates from and against any claim, loss, liability, damage, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site or our products, or your violation of any law or third-party right.

15. Third-party services

The Site links to or integrates with third-party services, including Razorpay, Shiprocket and integrated couriers, MSG91, Google, Meta (Facebook, Instagram, WhatsApp), and Cloudflare. KCT is not responsible for the content, terms, or practices of any third-party service, and your use of those services is also subject to their own terms.

16. Force majeure

KCT shall not be liable for any failure or delay caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, civil unrest, government action, courier or logistics disruption, internet or power outages, and acts of God.

17. Modification of Terms

We may revise these Terms at any time by posting the updated version on the Site, with the "Last updated" date reflecting the change. Your continued use of the Site after any update constitutes acceptance of the revised Terms.

18. Suspension and termination

We may suspend or terminate your access to the Site, your account, or any service at our discretion, with or without notice, for breach of these Terms or for any other reason permitted by law. Termination does not affect rights or obligations that have already accrued.

19. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to the dispute-resolution clause below, the courts at Anand, Gujarat shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

20. Dispute resolution

Customers are encouraged to first contact us at [email protected] or our Grievance Officer (see Privacy Policy) for any grievance. Unresolved disputes will be referred first to good-faith mediation at Anand, Gujarat, and only thereafter to litigation in the competent courts at Anand, Gujarat.

21. Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with the policies referenced above, constitute the entire agreement between you and KCT regarding the Site, superseding any prior agreements or understandings.
